A store in Punjab charged Rs. 8 for carry bag, got fined for Rs. 32,000

On Thursday, the District Consumer Disputes Redressal Forum in Mohali, Punjab imposed a fine of Rs. 30,000 on Zirakpur store on the grounds of charging extra Rs. 8 for a carry bag. Ruling against the traders, the forum said that the traders did not possess any legal or moral right to charge an extra amount for a carry bag.

What Happened?

Karan Singla, a resident of Nirvana Society, Sector 49, Chandigarh,Punjab had purchased a shirt from the Zirakpur store on February 10, 2019, and after his purchase, he was asked Rs. 8 extra for the carry bag.

Singla took the matter to the District Consumer Disputes Redressal Forum alleging a lack in the service from the side of the shopkeeper. In his complaint, he also claimed that the Zirakpur store had no right to charge an extra amount for the carry bag, as it was difficult for him to carry the shirt without a carry bag. Now, he demands a refund of Rs. 8 charged for the carry bag along with a compensation of Rs. 4.5 lakhs. He further demands Rs. 40,000 as litigation expenses.

Forum’s Action

Commenting on this judgment Forum president Sanjiv Dutt Sharma and member Natasha Chopra said “We feel that a carry bag is a part and parcel of the sale by the opposite party that had no legal or moral right to charge Rs. 8 extra for it. Such malpractice should be curbed with a strong hand. There is an unfair trade practice adopted by the opposite party.

The forum along with its members further said that there are possibilities that the opposite party might have continued this malpractice for years and have collected a good amount out of it.

In order to curb these practices and save customer’s rights it is quintessential to impose a special cost on malpractitioners so that a correct message reaches in our society, the forum added.

What is the outcome?

The forum directed the Zirakpur store to deposit Rs. 30,000 in its Legal Aid Account and pay Rs. 2,000 as compensation to Karan Singla in 30 days. Means, an overall fine of Rs. 32,000.

Thus, Karan Singla will be getting the refund amount of Rs. 8 along with Rs. 2,000 as compensation by Brand Factory, Cosmo Plaza, Zirakpur.
