New Delhi: Delhi Government has permitted Delhi Police to prosecute Umar Khalid and Sharjeel Imam.
Umar Khalid is the former student of Jawaharlal Nehru University. And Sharjeel Imam is its PhD student. The sanction has been given for prosecution in Delhi Riots case under UAPA(Unlawful Activities Prevention Act).
Prosecution against Faizal Khan, co-accused in the case also has been sanctioned:
Besides, Umar Khalid and Sharjeel Imam, the sanction for the prosecution have also been given against Faizal Khan. Faizal Khan is also accused in the case.
Supplementary charge sheet to be filed soon by the special cell:
After the first charge sheet filed in mid-September, a supplementary charge sheet in the case will soon be filed by the special cell. In the first charge sheet, 15 individuals including Pinjra Tod members were accused.
Here’s what the sanction letter states: “On a careful perusal of the draft supplementary charge sheet in FIR number 59 — registered at Crime Branch and being investigated by the Special Cell — under Sections 16, 17 and 18 of UAPA and on consideration of the allegations and other material placed on record, and after considering the report of the authority appointed under Section 45(2) of UAPA to review the evidence gathered during the investigation, the three accused have prima facie committed the offences under UAPA.”
Delhi Police gets the sanction from Delhi govt for the prosecution of Umar Khalid and Sharjeel Imam:
As a senior officer revealed that to prosecute a person under section 13 of UAPA, Delhi police needs a sanction from the ministry of home affairs. On the other hand prosecution under sections 16,17, and 18 of UAPA required the sanction from Delhi government. Earlier in the Delhi riots case, sanction was given the ministry of home affairs.
